This is the first time in Beijing that a case involving the use of artificial intelligence to impersonate well-known hosts for false advertising has been investigated. The case involves a company that used AI technology to edit videos of CCTV's famous hosts, added self-created voiceover content, and published advertisements on its own online video account, promoting a common food product called "Deep Sea DHA Fish Oil."
The advertisement claimed that the product could solve a series of health issues such as dizziness, headache, numbness in hands and feet, and weakness in limbs. This practice violated relevant provisions of the People's Republic of China Advertising Law, and the company has been given administrative penalties according to law. The regulatory authorities emphasized that ordinary food is not equivalent to medicine or health products and cannot be advertised as having medical effects or treatment functions.
The Beijing Market Supervision Bureau reminded consumers that the images of public figures such as hosts and influencers are often exploited by unscrupulous merchants to conduct false advertising, thereby infringing on consumer rights. Consumers who discover similar illegal acts can report them by calling 12315 or 12345 hotlines to jointly maintain a healthy advertising market order.
At the same time, the market supervision bureau also issued a warning to operators, urging them to strictly abide by laws and regulations such as the Advertising Law and the Anti-Unfair Competition Law, and to prohibit the use of AI technology to impersonate others' names or images for marketing purposes.
This case's investigation is not only a crackdown on false advertising but also demonstrates the regulatory authorities' determination to maintain market order in the context of emerging technologies.
