OpenAI has called on the attorneys general of California and Delaware to investigate Elon Musk and his affiliates for improper and anti-competitive behavior. In the letter, OpenAI pointed out that Musk is trying to hinder the company's development and obstruct its mission to achieve artificial general intelligence (AGI) through lawsuits and alliances with competitors. The legal cases between the two sides are expected to go to trial this month.

Musk sued OpenAI and its CEO Sam Altman in 2024, claiming that OpenAI violated its original mission during its transition to a for-profit entity. Notably, Musk was one of the co-founders of OpenAI, but he left in 2018 and later founded the competitor xAI, launching its chatbot Grok.
In a court filing last year, OpenAI stated that Musk tried to convince competitor Mark Zuckerberg to join his takeover offer for OpenAI, but Zuckerberg did not participate. Jason Wang, OpenAI's chief strategy officer, mentioned in the letter that Musk's lawsuit demands over $10 billion in compensation from OpenAI's non-profit foundation, which would severely impact OpenAI and could even lead to its paralysis.
Jason Wang also emphasized that this lawsuit could undermine OpenAI's efforts to ensure that artificial general intelligence benefits all humanity. He said that Musk's documents show that the California Attorney General's office did not conduct a thorough investigation into OpenAI's capital restructuring plan, but instead relied on promises about OpenAI's future actions. This case will be heard by a jury presided over by a California judge and is expected to begin in April.
