As the 26th World Intellectual Property Day approaches, the Hangzhou Intermediate People's Court publicly heard a highly anticipated case of unfair competition on April 23. This case involves the field of artificial intelligence, particularly the issue of "AI intelligent entity traffic hijacking." The presiding judge is Tang Xuebing, a senior judge at the Hangzhou Intermediate People's Court.

The plaintiff is a company that develops and operates an AI application called "K Intelligent Entity." This application integrates multiple AI functions such as search, writing, and translation, attracting a large number of users and becoming an important tool for its market competition. The defendants include two companies responsible for developing and operating the application, as well as a company providing APP point exchange services.

The plaintiff accused the defendants of embedding a feature called "W Intelligent Large Model" in their input method. This function guides users to the "W Intelligent Large Model" through "search suggestions" while using the "K Intelligent Entity," covering the interface of the "K Intelligent Entity." The plaintiff believes this behavior constitutes traffic hijacking, causing serious economic losses, and therefore filed a lawsuit with the court, requesting the defendants to stop the infringement, make a public statement to eliminate the impact, and compensate for up to 100 million yuan in economic losses and reasonable costs of rights protection.

However, the defendants argued that their input method provides diversified service options based on user needs and believe their actions fall within the scope of fair competition and comply with commercial ethics. The core issue of this case lies in how to define the defendant's behavior—whether it is the traffic hijacking alleged by the plaintiff or the positive competition claimed by the defendant.
